TECHNICIANS

General Conditions for Supplying Technicians

  1. Purchase Order Receipt

Receipt of a customer’s Purchase Order or Work Order constitutes the placing of an order by a properly authorised representative of the customer and the customer acknowledges the standard terms of service for technicians mentioned in this document which are applicable throughout BoltPrep’s engagement.

  1. Skilled Technicians

Boltprep will provide appropriately skilled technicians to fulfil all servicing requirements in their capacity as an employee of BoltPrep.

BoltPrep is responsible for all tasks performed by their employees in the performance of their contractual duties and for the avoidance of any doubt, Boltprep is not responsible for the work performed by technicians assigned by parties external to BoltPrep.

  1. Scope of works

Once the scope of work has been defined, BoltPrep is responsible for the management of the project work as defined during the scope phase of the engagement.

Below are typical engagement parameters:

A          Define scope of work to be carried out

B          Analyse and define work methodology

C         Perform required work

D         Prepare reports – equipment output and conclusions

E          Remedies; propose and implement, depending on case

Change in Scope

In cases where the scope of work changes during the engagement, it is the customer’s responsibility to notify BoltPrep of these changes so that appropriate personnel and equipment can be sourced based on the modified scope. A risk assessment is prepared for every engagement and the risks need to be re-assessed in line with any modified scope of works to be undertaken. BoltPrep will provide an updated schedule of rates and fees.

BoltPrep requires mobilising relevant personnel prior to the engagement and therefore order cancellations can only be received up to 48 hours prior to commencing travel to the customer’s premises. Cancellations received outside the 48 hour notice period attract the standard day rate.

  1. Day Rates (tabulated)

Upon placing the order with BoltPrep, the Daily Rates as quoted will apply throughout the engagement. An authorised member of your staff will be required to validate Boltprep technicians’ timesheets. Validation of work hours signifies acceptance of the work completed and the invoices are due and payable as per this standard agreement.

All engagements are payable 7 days after the receipt of the invoice irrespective of whether or not a formal report has been issued by BoltPrep.

There will be a minimum shift fee of 12 hours for each technician. Boltprep’s day rates are based on technicians working a maximum of 12 hours; any extra time worked will be paid as overtime at a rate 1.5 times the standard rate. If technicians work less than 12 hours the full day rate will apply. Travel time is also charged at Boltprep’s standard day rates.

Mobilisation costs are payable 7 days in advance prior to commencement of the engagement. No personnel is dispatched without receipt of mobilisation costs.

As BoltPrep requires mobilising relevant personnel prior to the engagement, order cancellations can only be received up to 7 days prior to commencing travel to the customer’s premises. Cancellations received outside the 7 day notice period will be charged at the standard day rate.

  1. Payment Terms

Unless otherwise agreed, Boltprep will invoice you weekly and our invoices are payable 7 days from the invoice date. For goods and services supplied in Australia, invoices shall carry a Goods and Services Tax (GST) at the prevailing rate. All payments under our Terms of Business shall be made in cleared funds, without any deduction or set-off, and free and clear of and without deduction for or on account of any taxes, levies, imports, duties, charges, fees and withholdings of any nature now or hereafter imposed by any governmental, fiscal or other authority except as required by law. If you are required to make any such deduction or withholding, you must pay Boltprep such additional amounts as are necessary to ensure receipt by Boltprep of the full amount which it would have received but for the deduction or withholding.

  1. Interest charged on overdue accounts

BoltPrep reserves the right to charge market rate interest on overdue accounts.

  1. Performance Concerns

You should advise Boltprep as soon as is practical if you are not satisfied with the work, performance of service, or behaviour of a Boltprep technician or contractor.

  1. Occupational Health and Safety

You must provide Boltprep technician with a suitable and safe workplace that complies with the relevant occupational health and safety laws.

Additionally, the following must be provided: Protective equipment relating to hazardous substances, written safe work procedure in place for all jobs or tasks undertaken by a Boltprep technician and that you provide those written safe work procedures to the Boltprep technician to become familiar in those procedures before they commence work.

You will notify Boltprep immediately of any work related incidents, injuries or non conformance issues affecting a Boltprep technician.

You acknowledge that we have mutual obligations in ensuring the health and safety of Boltprep technicians and you agree to make any appropriate changes to help reduce the risk of accident in your workplace.

You acknowledge that Boltprep does not have control of the workplace and that it relies on you, the customer, to inform us of potential risks to the safety and welfare of our employees. You undertake and agree to notify us of potential risks affecting our technicians.

We encourage our technicians to report any unsafe work conditions to their immediate supervisor and BoltPrep has a Drug and Alcohol Free Policy in place that prohibits its employees from working under the influence of any performance inhibiting substances.

  1. Confidentiality

All our employees are required to sign a Confidentiality Agreement to ensure the customer’s information remains confidential at all times.

  1. Insurances

Boltprep will maintain the following insurance policies in relation to Boltprep and its technicians:

– Workers Compensation Insurance as required by law.

– Public Liability

  1. Liabilities and Indemnities

Boltprep is not liable on any legal or equitable basis, including negligence, for any acts or omissions of a Boltprep technician.

All information regarding our technicians must be treated as confidential and must not be disclosed to any third party.

  1. Liabilities and Indemnities

Boltprep technicians are under your care, direction and control.

(a) You receive Boltprep technicians at your sole risk and hereby release Boltprep and its employees from, and indemnify them against, any claim or liability for the loss or damage to property owned, operated or leased by you and property that is in your custody, care or control, including motor vehicles, trucks and their contents.

(b) To the extent permitted by law, Boltprep’s liability to you for damages in contract, tort or under any Statute or Regulation for breach of contract, negligence or breach of Statute or Regulation in the performance of, or incidental to, supply bolting services shall be limited to the cost of the resupply of the services and shall not extend to consequential or indirect loss or damage or punitive or exemplary damages.

  1. Disputes

These Standard Terms and Conditions – Technicians shall be governed by the laws of the State of Western Australia and the parties submit to the non-exclusive jurisdiction of the courts of that state.
